Colour & Creativity Art Program Terms & Conditions, Participation Waiver & Media Consent

PARTIES

This Agreement is entered into between Community Migrant Resource Centre (CMRC) and delivery partner Artist Hub Sydney, including their employees, contractors, volunteers and project partners (“we”, “us”, or “our”), and you, the participant enrolling in the Colour & Creativity Program (“you”, “your”, or the “Participant”).

Where the Participant is under 18 years of age, this Agreement must be accepted by a parent or legal guardian.

PROGRAM DETAILS

Program Name: Colour & Creativity – Art Workshops

Duration: 10 Weeks (weekly sessions)

Locations:

Primary Venue: Bella Vista Pocket Park

Alternate Venue: CMRC Bella Vista Office, Unit 108 / 20B Lexington Drive, Bella Vista NSW

Activities include drawing, colouring, creative exercises, art instruction, and related workshop activities.

ACCEPTANCE

You accept this Agreement by signing (including electronically), registering for the program, paying any program fees, or attending the workshops.

By accepting, you confirm you have read and understood these Terms and agree to be bound by them.

10-WEEK COMMITMENT

Participants understand the program runs for 10 consecutive weeks. Enrolment reserves a place for the full duration. Missed sessions are generally non-refundable and non-transferable unless agreed by organisers.

RISK ACKNOWLEDGEMENT

Participation may involve risks including minor injuries, slips or falls, weather exposure, allergic reactions, and interaction with other participants or the public. Participation is voluntary and at your own risk.

HEALTH & MEDICAL DISCLOSURE

Participants must inform organisers of medical conditions, allergies, or special needs and provide emergency contact details.

FOOD & ALLERGY CONSENT

Light snacks may be provided. Participants are responsible for informing organisers of allergies. CMRC will take reasonable precautions but cannot guarantee allergen-free environments.

CODE OF CONDUCT

Participants agree to follow facilitator instructions, behave respectfully, use equipment safely, and notify staff of hazards or injuries.

RELEASE AND INDEMNITY

To the maximum extent permitted by law, participants release CMRC, Artist Hub Sydney, Landcom and partners from liability for injury, loss or damage arising from participation and indemnify organisers against related claims.

AUSTRALIAN CONSUMER LAW WARNING (NSW)

Participation in recreational activities involves risk. By accepting these Terms you acknowledge participation is at your own risk.

CHILDREN

Parents/guardians consent to participation and accept responsibility for participants under 18.

PHOTOGRAPHY & VIDEO CONSENT

You grant permission for CMRC and partners to photograph and record participants and use materials for promotional, educational and reporting purposes without compensation. Consent may be withdrawn in writing for future use.

ARTWORK LICENCE & USE

Participants retain ownership of their artwork but grant CMRC and partners a perpetual, royalty‑free, Exclusive licence to use, reproduce and display artwork for exhibitions, promotion and reporting, with attribution where possible.

PROPERTY & PERSONAL ITEMS

Participants are responsible for their belongings. Organisers are not liable for loss or damage.

PROGRAM CHANGES

Organisers may change venues, schedules or cancel sessions due to safety or unforeseen circumstances.

GOVERNING LAW

This Agreement is governed by the laws of New South Wales, Australia.
